The Ukrainian Justice Ministry has said that the participants in a tender for the sale of OJSC Odesa Port-Side Plant will challenge the decision of the tender commission in courts.
“Taking into account the commission’s decisions, the plant is still
in state ownership. One should expect court appeals from tender
participants, and I think that so they will try to protect their
rights,” Justice Minister Mykola Onishcuk told the press before a
cabinet meeting on Wednesday.
He also said that the disciplinary commission of the Supreme Court
of Ukraine is to consider appeals on the unlawfulness of court rulings
concerning the plant.
He said that only courts of higher instance have the right to assess court rulings.
The minister said that taking into consideration the practice of the
Supreme Court of Ukraine, disciplinary punishment is imposed if judges
commit deliberate or mistaken violations of the law.
