One of the founders of Arzinger, attorney, Ph.D. Sergii Shkliar returns to Arzinger team to the position of Founding Partner. Sergii will concentrate on the practices of Antitrust & Competition, Insolvency, Dispute Resolution, including in other jurisdictions, International Arbitration and GR.

From 2015 to 2018, Sergii Shkliar served as the deputy Minister of Justice of Ukraine on Executive Service matters. During 2016-2017, in accordance with the segregation of duties between deputies of the Minister of Justice of Ukraine, he oversaw the representation of the interests of the state in foreign jurisdictional bodies.

Sergii is a Candidate of Law, a Doctoral Student (the theme of his dissertation is “Control over observance of the legislation on protection of economic competition in Ukraine: the administrative and legal principles of organization and functioning”), and a professional of the highest level, as recognized both by legal practitioners and academic communities in Ukraine and abroad. Repeatedly such authoritative ratings as Chambers Global and Chambers Europe, Who’s Who Legal and The Legal 500 recognized Sergii among the best lawyers of Ukraine.

Sergii Shkliar was educated in Ukraine and Europe. He has many times defended the interests of domestic and international companies in the Ukrainian courts and the courts of other jurisdictions, including arbitration institutions. He has been a member of the Judicial Reform Council of the President of Ukraine (Decree of the President of Ukraine No. 826/2014) since it was established; the author of the Laws of Ukraine “On the bodies and individuals who carry out the enforcement of court decisions and decisions of other bodies” and “On enforcement proceedings”; as well as the developer of new procedural codes: the civil procedural code, the economic procedural code, and the code of administrative legal proceedings. He is a Chairman of the Supervisory Board on compliance with the requirements of the Law of Ukraine “On Financial Restructuring”, senior lecturer of the Department of Sectoral Legal Sciences of the Faculty of Legal Sciences of the National University of Kyiv-Mohyla Academy (from 01.09.2010), course on Competition Law. Sergii is an official representative of the International Development Law Organization (IDLO) (until March 18, 2015), a member of the Scientific Advisory Board of the Supreme Court of Ukraine since its creation.

As the Head of Dispute Resolution practice at Arzinger, Sergii:

– represented, in cooperation with a Swiss law firm, a prominent Swiss company in a 7 million euros dispute with the Ukrainian government authority considered under the UNCITRAL Arbitration Rules;

– represented a large Austrian company in court proceedings for enforcement of an several million dollars arbitral award, adopted in accordance with the Rules of the Vienna International Arbitral Center;

– represented one of the global agribusiness and food companies in a major multi-million dollar investment dispute concerning seaports infrastructure

In addition to his professional activities, Sergii Shkliar actively participates in reforming civil society in Ukraine. He is the president of the All-Ukrainian NGO “Association for the Suppression of Unfair Competition”; a co-founder of the non-profit partnership of CIS countries “Promotion of competition development”; and an expert for the EU’s TACIS program in the “Harmonization of the system of competition and public procurement to EU standards” project.
