You're reading: Court cancels building norm prohibiting construction of high-rise buildings near Kyiv

The Sixth Administrative Court of Appeal has dismissed a complaint of the Ministry of Communities and Territories Development against the decision of the District Administrative Court of Kyiv, seeking to declare it illegal to cancel the order of the Ministry on fixing a ban on the construction of multi-storey buildings in villages with a population of more than 1,000 people and homestead type areas in the public building codes.

“On Wednesday, the clause of the public building codes prohibiting the construction of high-rise buildings in satellite villages of Kyiv was canceled in court. On Sept. 1, the Administrative Court of Appeal upheld the decision of the court of lower instance. From Sept. 2, the decision came into force, this norm of the public building codes is no longer valid,” lawyer, board member of the Ukrainian Bar Association Yuriy Khapko said on Facebook on Sept. 3.

According to him, the decision opens up new opportunities for developers in the suburbs.

“It’s not a secret for anyone that Kyiv city and the region are long-standing competitors in terms of real estate buyers. Recently, the suburb has begun to outstrip the capital of Ukraine in terms of the volume of new construction due to a number of factors. With the approval of this decision, this trend in the market may continue,” the expert said.

According to clause B.2.2-12: 2019 Planning and development of territories of the public building codes canceled by the court, the limited permissible height of residential buildings in villages with a population of more than 1,000 people was 12 meters (four floors). The placement of multi-apartment (sectional) houses in the homestead type areas was not allowed.
