The Sixth Administrative Court of Appeal on Feb. 16 postponed the consideration of PrivatBank’s claim against the decision of the Kyiv District Administrative Court of April 18, 2019 in the case of the lawsuit filed by businessman Ihor Kolomoisky on the illegality of the bank’s nationalization until March 2, PrivatBank’s legal advisor Andriy Pozhydayev said.
“The court postponed the consideration of the case due to the fact that it needs to demand official information from the Constitutional Court about whether the revision [of the constitutionality of the ‘banking’ law] is being carried out and on what grounds it is being carried out,” he said in a video message on Feb. 16.
Pozhydayev noted that there is no need to stop the proceedings, since the recognition of the banking law as constitutional or not will not affect the consideration of this case. He added that the proceedings in this case should be closed, as it cannot be considered in an administrative court.
As reported, Kyiv District Administrative Court on April 18, 2019, under the suit of Kolomoisky, overturned the NBU’s decisions on the withdrawal of the insolvent PrivatBank from the market with the participation of the state and determining the list of persons associated with the bank.
PrivatBank on May 27, 2019 filed an appeal against the court’s verdict on canceling the decision to withdraw the insolvent PrivatBank from the market with state participation, and on May 24 an appeal against the court’s verdict on canceling the decision of the NBU commission on determining the list of persons associated the bank.
On Dec. 18, 2016, the government of Ukraine, referring to the proposal of the NBU and former shareholders of PrivatBank, the largest of which at that time were Ihor Kolomoisky and Boholiubov, decided to nationalize this largest financial institution on the Ukrainian market and injected over Hr 155 billion into its capital.
The former owners of the bank consider the nationalization carried out, as a result of which they completely lost their shares, illegal, while PrivatBank and the state demand additional compensation from them.
