Kyiv’s business court has not satisfied a claim of NJSC Naftogaz Ukrainy against the Cabinet of Ministers of Ukraine seeking a compensation for losses of Hr 6.6 billion appeared in the fourth quarter of 2015 when public servicing obligations (PSO) were imposed on Naftogaz to supply gas for the needs of households and heat supplier at the price lower than the market price.

The court decision made on Feb. 28 was posted in the unified register of court rulings at the end of March.

“The court decides not to satisfy a claim of NJSC Naftogaz Ukrainy against the Cabinet of Ministers and the State Treasury Service seeking to collect a refund of a loss in the amount of Hr 6.634 billion at all,” the court said in the ruling.

As reported, Naftogaz in October 2018 filed a lawsuit to Kyiv’s business court against the Cabinet of Ministers of Ukraine seeking to refund the loss of Hr 6.6 billion appeared in the fourth quarter of 2015 over the refusal of the government to create a mechanism for compensation for gas supplied under PSO and the sources of this compensation. Naftogaz supplies gas for the needs of households and hear supplier at Hr 8,550 per 1,000 cubic meters (before April 2019 the price was lower than the price of gas imported by Naftogaz Ukrainy).
