The Supreme Court of Ukraine partially upheld a claim of Vitkovice Steel (the Czech Republic) against PJSC Dniprovsky Integrated Iron & Steel Works (DMK, Kamianske, Dnipropetrovsk region) in a case on recovering Hr 31.960 million of funds overpaid under a contract, having canceled the decisions of lower courts and sent it for new consideration to the Economic Court of Dnipropetrovsk region.

According to a decision of the Supreme Court dated October 13 of this year, Vitkovice Steel’s cassation appeal was partially upheld.

“A ruling of the Economic Court of Dnipropetrovsk region of March 16, 2021 and a decision of the Central Economic Court of Appeal of May 25, 2021 in case No. 904/2104/19 shall be canceled. Case No. 904/2104/19 shall be sent for new consideration to the Economic Court of Dnipropetrovsk region. A ruling of the Cassation Court comes into legal force from the moment of its adoption, is final and not subject to appeal,” the Supreme Court stated in the ruling.

In accordance with the materials of the case, a copy of which is at the disposal of Interfax-Ukraine, Vitkovice Steel signed a contract with DMK on Jan. 28, 2016 and transferred $3.1 million to the steel plant, however, the Czech company received less products – the overpayment amounted to $1.074 million, which the company demands to recover.
