You're reading: Constitutional Court receives submission of 50 MPs on ‘unconstitutionality’ of NEURC appointments

A submission on the inconsistency of the Constitution of Ukraine with presidential decrees on the appointment of the National Energy and Utilities Regulatory Commission (NEURC) members was received by the Constitutional Court of Ukraine (CC) on Nov. 3, the Constitutional Court and Legal Monitoring Department reported on Nov. 4.

It is reported that the widespread text of the presentation is signed by 50 MPs of Ukraine, including the leader of the Batkivschyna faction, Yulia Tymoshenko, as well as MPs of this faction, the Servant of the People faction, Oppositon Platform – For Life and European Solidarity, the Dovira and non-factional groups.

In the submission, the parliamentarians ask to admit unconstitutional the decrees of 2018-19 on the appointment of seven members of the NEURC: Olena Antonova, Dmytro Kovalenko, Oksana Kryvenko, Ruslan Kaidash, Olha Babiy, Valeriy Tarasiuk and Oleksiy Mahda.

Also, the MPs ask to recognize as unconstitutional the transitional provisions of the law On NEURC No. 1540-VIII of 2016 on the powers of the president to ensure the sustainable activities of the NEURC, as well as two points from the transitional provisions of the law No. 394-IX on amendments to the law on ensuring constitutional principles in the field energy and utilities from 2019, which relate to the activities of these members of NEURC.
