You're reading: Court cancels certain provisions of law on protection of citizens affected by Chornobyl

The Constitutional Court has recognized as unconstitutional certain provisions of the law “On the Status and Social Protection of Citizens Who were Affected by the Chornobyl Disaster,” said Olha Sovhyria, representative of the Verkhovna Rada in the Constitutional Court (Servant of the People faction).

“The Constitutional Court (Second Senate) has today adopted the first decision since the beginning of the constitutional crisis on a constitutional complaint about the unconstitutionality of certain provisions of the law ‘On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster’… The Constitutional Court agreed with the position of those who appealed,” wrote Sovhyria on Facebook on April 7.

She explained that according to this law, the method for determining the amount of pensions was changed since 2015, and as a result, the minimum amount of pensions guaranteed by the state was significantly reduced, which violated the state’s obligations to ensure social protection of citizens affected by the Chornobyl disaster.

Sovhyria also recalled that the constitutional complaint had been under consideration by the Constitutional Court of Ukraine since September 2018.
