You're reading: Court initiates proceedings on Tupytsky’s lawsuit against selection of candidates under president’s quota

The District Administrative Court of Kyiv City has initiated proceedings in a lawsuit against the President’s Office of Ukraine and the Constitutional Court of Ukraine (CC) competition commission’s decision on candidate selection for the position of judge with regard to persons appointed by the president of Ukraine.

“Oleksandr Tupytsky and Oleksandr Kasminin are the plaintiffs, while President of Ukraine Volodymyr Zelensky and the Constitutional Court of Ukraine are the third parties,” the court’s press service said.

The requirements of the lawsuit are the following: to recognize unlawful and overturn the decision of the competition commission dated Aug. 20, formalized by the protocol No.1, which decided to approve the announcement of the competition for candidate selection for the position of judge of the Constitutional Court in respect of persons, appointed by the president of Ukraine.

“The plaintiffs also challenge the actions of the competition commission and the President’s Office of Ukraine on the placement of the announcement on the website of the Official Internet Representation of the President of Ukraine and ask the court to oblige the competition commission to withdraw this announcement,” the court said.

The court decided to consider the case according to the rules of simplified proceedings without notifying the parties.
