You're reading: Court suspends proceedings in Tupytsky dismissal case

The Administrative Court of Cassation within the Supreme Court of Ukraine has suspended proceedings in one of the cases on the dismissal of a judge of the Constitutional Court of former head of the Constitutional Court Oleksandr Tupytsky.

At the hearing on June 14, the Administrative Court of Cassation within the Supreme Court considered case No. 9901/57/21 at the suit of Tupytsky on appeal against presidential decree No. 79/2021 on the dismissal of a judge of the Constitutional Court of Ukraine (on the dismissal of a judge from February 28 2021 for a period of one month) dated February 26, 2021 from the date of its adoption, the court’s press service said.

“During the trial, the defendant’s representative filed a motion to suspend the proceedings in this case until the entry into force of the judgment in case No. 9901/43/21 at the suit of Oleksandr Tupytsky, in which President of Ukraine decree No. 607/2020 on the dismissal of a judge of the Constitutional Court of Ukraine (on the dismissal of a judge for a period of two months) dated December 29, 2020 was appealed,” the court said.

The Supreme Court granted this request.

The ruling can be appealed to the Grand Chamber of the Supreme Court.
