On June 19, the Verkhovna Rada of Ukraine adopted a law on supporting and developing national projects in the fields of culture and arts, creative industries, national musical products, and cultural and educational domestic tourism. The law prohibits any music videos broadcasting and touring events of citizens of the aggressor state.
The laws of Ukraine have changed concerning cinematography, touring events in Ukraine, television and radio broadcasting, culture, the Ukrainian cultural fund, management of property rights of copyright holders in the field of copyright and/or related rights, and even road transport.
New legislation prohibits the screening of films or TV programs, except informational and information-analytical TV programs, where participants include anyone on the List of persons who pose a threat to national security.
The List is compiled by the apparatus of the National Security and Defense Council of Ukraine based on requests from the Security Service of Ukraine (SBU), the National Council of Ukraine on Television and Radio Broadcasting, and the central executive body that ensures the formation of state policy in the field of culture.
Also prohibited on the territory of Ukraine are public performances, displays, demonstrations, notification of phonograms, videograms, and music clips that contain a recorded performance of a musical non-dramatic work with lyrics by a singer who is or was in any period after 1991, a citizen of the aggressor state. This excludes former citizens of the aggressor state who are, or at the time of death were, citizens of Ukraine.
The prohibition does not apply to phonograms, videograms, and music clips that are distributed or used during retransmission or cable retransmission, or programs of foreign broadcasting organizations except for the broadcasting organizations of the aggressor state.
The ban also does not apply to phonograms, videograms, and music clips that contain a recorded performance by a singer who is included in the List of musical performers/singers of the aggressor state who condemn the aggression against Ukraine.
The Ukrainian Cultural Fund will provide grants of institutional support to legal entities of all forms of ownership to ensure competitiveness and create jobs during the conditions of martial law or a state of emergency, or the adoption of administrative and/or medical and sanitary measures (e.g. quarantine).
The fund will also provide grants for supporting and developing projects in culture and arts, creative industries, national musical products, and cultural and educational domestic tourism.
At least 50 percent of broadcast content by television and radio organizations must be national audiovisual products, with some exceptions that don’t relate to the ban on the products of the aggressor state and/or the occupying state.
At least 75 percent of the daily volume of broadcasts, including news, analytical and entertainment programs must be in the state language.
Until the territorial integrity of Ukraine is restored within the internationally recognized state border, organizations that are part of the Register of Collective Management Organizations in Ukraine are prohibited from entering into agreements on the representation of rights with organizations registered in the aggressor state and from taking actions based on agreements concluded with these organizations.
Going forward, a bus driver is prohibited from playing music, movie sounds, or other sound signals in the bus cabin, except for information about the trip. Sound can be transmitted to the individual headphones of passengers and the cabin with the consent of all passengers and only during non-regular transportation.
A taxi driver is prohibited from playing music or other sound signals in the cabin without the consent of all passengers.
