You're reading: Ukrenergo sues relevant ministry due to long approval of investment program

Ukrenergo has filed a lawsuit to the Kyiv District Administrative Court demanding that the inactivity of the Ministry of Energy and Environment Protection regarding the approval of the company’s investment program for 2020 be declared unlawful and the ministry be obliged to approve the document as soon as possible, the press service of Ukrenergo has said.

According to the procedure for the formation of investment programs (approved by resolution No. 1972 of the National Commission for Energy, Housing and Utilities Services Regulation of June 30, 2015), after public discussions, Ukrenergo submits the document developed by the company for approval to the ministry as the body responsible for the formation and implementation of state policy in the energy sector. After that, the program is sent for approval to the regulator.

The Ukrenergo program on September 23 passed open discussions, received approval from 22 regional state administrations, and on September 25 was sent to the ministry. Despite the fact that the period for consideration of such documents should not exceed one month from the moment of their receipt, the agency has not yet agreed on the investment program and has not provided any comments on it.

“If the investment program for 2020 is not agreed by the end of the current year, from January 1, 2020, the possibility of implementing all projects for building and reconstructing networks and making settlements with counterparties, including within the framework of international investment projects, will automatically be blocked,” the report says.
