On Jan. 16, 2014,
the Verkhovna Rada “adopted” laws without legitimately voting for
them.
This isn’t just a
blatant crime, for which those guilty, when the time comes, will face criminal
liability; it’s also the final step in the elimination of Ukrainian
parliamentary system as the main branch of state authority in Ukraine.
I am convinced that
everything that happened in parliament was sanctioned by Viktor Yanukovych.
Today, by deliberately killing parliamentary system, he took another major step
towards establishing dictatorship in Ukraine.
I believe the
parliamentary opposition must do the following:
First. Send open public letters as soon as possible to Yanukovych and
Rybak demanding them not to sign these laws that parliament did not vote for,
with a clear set of purely legal arguments proven by quality videos.
Second. If, after such public letters, Yanukovych and V.Rybak nevertheless
will sign these illegitimate laws, I ask the parliamentary opposition
immediately on the day of signing of these laws, to submit a legally
motivated crime statement to the General
Prosecutor’s Office about the crime of Yanukovych V.Rybak, I.Kalyetnik, V.
Oliynyk and other involved and to achieve inclusion of this statement in the Prosecutors
General’s office
Third. I ask the opposition to transmit immediately
the complaint to the court about the process of passing laws been falsified and to admit this
voting as invalid.
Fourth. I ask the opposition to push this legal case about illegitimacy of approval
the set of laws on January 16th in Verkhovna Rada through all
possible Ukrainian courts and submit it as quickly as possible to the European
Court of Human Rights and ask them to consider this case as a priority.
Fifth. Regardless of what the Ukrainian courts and Prosecutor General’s
Office will do to stop the illegitimate voting process in the Verkhovna Rada
(most likely they will allow this crime to happen), I ask the opposition to
create a public commission of leading human rights activists which together
with journalists will investigate the crime of falsification on January 16th
and make fair demands to the Ukrainian authorities. That expert opinion may have
to be included in the application to the European Court.
I ask the opposition
and civil society to act quickly and decisively because we won’t be defending
the law, which Yanukovych humiliated on January 16, but Ukrainian parliamentary
system which is the final barricade before the total establishment of
dictatorship.
I ask the opposition
to act immediately.
